**** HARNARESH SINGH GILL , J. (ORAL) Case is taken up for hearing through video conferencing. The petitioner seeks regular bail in FIR No. 16 dated 28.1.2019 under Sections 302, 148, 149, 201 and 34 IPC registered at Police Station Tibba, District Police Commissionerate, Luthiana. Custody certificate by way of affidavit of Deputy Superintendent, Central Prison, Ludhiana has been filed through e-mail. Copy of the same is taken on record.
Learned counsel for the petitioner submits that neither the petitioner has been named in the FIR nor any injury has been attributed to him. Rather, the petitioner has been named by the complainant, in the supplementary statement after two days and he has been in custody since 29.1.2019.
On the other hand, learned State counsel submits that in the GURPREET SINGH 2020.09.18 17:46 I attest to the accuracy and integrity of this document Chadigarh supplementary statement, the petitioner has been specifically named by the
CRM-M No. 1977 of 2020 -2complainant. He further submits that charges were framed on 04.7.2019 but out of 21 prosecution witnesses, none has been examined. The petitioner has been in custody since 29.1.2019. Charges have been framed but no witness have been examined so far. The trial will take time to conclude because of COVID-19 pandemic. No useful purpose would be served by keeping the petitioner behind the bars. Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
