SANDEEP MOUDGIL, J (ORAL) Prayer in the instant petition filed under Section 482 Cr.P.C is for quashing of impugned order dated 09.12.2024 passed by learned Addl. Sessions Judge, Gurdaspur in case FIR No.0182 dated 04.09.2021 under Sections 302/34 IPC registered at P.S Civil Lines Batala, District Gurdaspur whereby bail of the petitioner has been cancelled and surety bonds were forfeited to the State. It is stated that an application was filed by the petitioner on 09.12.2024 (Annexure P.5) for exemption from personal appearance on account of his being down with viral fever but the same was declined by the learned Addl. Sessions Judge recording that the application has come late on the day as nonbailable warrants already stood issued. Notice of motion.

Mr. J.S. Guru, AAG, Punjab, who is present in Court, accepts notice on behalf of respondent-State.

Learned counsel for the petitioner submits that he has instructions to undertake that the petitioner will surrender before the trial Court within a period of MANOJ KUMAR 2025.01.18 21:34 I attest to the accuracy and authenticity of this order

CRM-M-1934-2025 #2# ten days from today and in future will not commit any default for his appearance except in accordance with law.

In the wake of above undertaking coupled with the fact that the alleged absence of the petitioner was bonafide as he was not well being down with fever, instant petition is allowed and order dated 09.12.2024 is set aside subject to the petitioner surrendering before the trial Court within a period of ten days. In case of his doing so, if an application is filed, the same shall be considered by the trial Court on the same date, as per law.

Disposed of accordingly.
