Present:
Mr. Amit Kumar Jain, Advocate for the petitioner.
CORAM:HON'BLE MR. JUSTICE K. KANNAN 1.
Whether Reporters of local papers may be allowed to see the judgment ?
2.
To be referred to the Reporters or not ?
3.
Whether the judgment should be reported in the Digest? -.- K. KANNAN J. (ORAL) 1.
The prayer for paying the amount in installments of the decree amount is brought in revision. This Court will make no intervention and if he has any such prayer, it shall be made before the decree is passed. If the decree is passed, under Order 20 Rule 11 CPC, the Court can grant time or allow for installments only if the decree holders wants it that way. There is no discretion left either for the Executing Court or this Court to allow for the amount to be paid in installments. The prayer sought is clearly untenable in law and there is no scope for making any intervention in favour of the judgment debtor. 2.
The revision petition is dismissed.
