Advocate General, Punjab. **** SHEEL NAGU, CHIEF JUSTICE (Oral) This is a repeat regular bail application filed by the petitioner in FIR No. 272 dated 30.08.2023 under Section 22(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (Section 29 of the NDPS Act added later on) registered at Police Station STF Phase IV Mohali, District Bathinda, after rejection of his earlier one on 16.12.2024 by this Court by granting liberty to revisit the Court after examination of all the seizure witnesses.

Learned counsel for the petitioner submits that there were three seizure witnesses cited by the prosecution, namely, Major Singh, Investigating Officer, ASI Des Raj and ASI Sohan Singh. ASI Sohan Singh has been given up by the prosecution while Major Singh, Investigating Officer, has been examined and cross examined while ASI RAVINDER KUMAR 2025.02.04 18:08 I attest to the accuracy and integrity of this document
CRM M No. 2238 of 2025 -2Des Raj has though been examined but his further cross-examination has been deferred for the next date of hearing.

In view of the above, all the seizure witnesses have not yet been examined by the prosecution and therefore, no new ground exist to grant regular bail to the petitioner and accordingly, this repeat application stands dismissed with the same liberty.
