The petitioner is a plaintiff in the suit for grant of decree of permanent injunction. The defendant No.1, on 03.07.2017, made a statement that he shall not interfere in the suit property and will not raise any other construction except the boundary wall and fencing of the land in question. The plaintiffs still did not permit defendant No.1 to construct. 2.
On the application filed by the defendants, the Court has provided police help to implement the order which was passed on 03.07.2017 on the basis of the statement recorded by the defendant No.1. The learned counsel representing the petitioner contends that under the garb of the aforesaid order, the defendant No.1 is constructing the shops. There is no material to prove that fact. The trial Court has examined the matter in detail and passed the order. The suit filed by the plaintiff is pending.
