The Court has dismissed the application for recall of the witness on the ground that the application is not maintainable. The order is erroneous and out of sync with the decision of this Court in Santosh Kumar Berry Vs. Nirmala Devi and others 2013(1) PLR 404. 2.

The order already passed is set aside, dispensing with notice to the respondents on condition that the petitioner pays costs of `5000/- to the respondents within one week from the date of receipt of copy of this order, failing which the order already passed will remain. 3.

The revision petition is dispsoed of with the above observations.
