(Oral) This is a petition for anticipatory bail filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, (BNSS), 2023 in case bearing FIR No.375 dated 24.12.2024 under Section 61 of Punjab Excise Act, 1914 registered at Police Station Dera Bassi, District S.A.S. Nagar, Mohali. 2.
The case of the prosecution is that on secret information, the police has recovered total seven boxes (each box containing 12 bottles) and 02 bottles of liquor from the rented house of the petitioner. 3.
Learned counsel for the petitioner contends that the petitioner is innocent and has been falsely implicated in the present case. He further contends that neither he was apprehended at the spot nor any recovery of alleged liquor bottles has been effected from the conscious possession of the petitioner by the police. He further states that he is a handicapped person suffering from Locomotor Disability to the extent of 75%. He further contends that the petitioner is not involved in any other case. 3.

CRM-M-1741-2025 -2had directed the petitioner to appear before the Investigating Officer and join investigation and in the event of his arrest, he was ordered to be released on adinterim bail to the satisfaction of the Investigating/Arresting Officer, subject to the conditions envisaged under Section 438(2) Cr.P.C. 4.
Learned State counsel on instructions states that the petitioner has joined the investigation and is not required for custodial interrogation. 5.
In view of the submissions of learned counsel for the petitioner especially when the petitioner has cooperated with the investigation, the order dated 15.01.2025 granting interim bail to the petitioner is made absolute. 6.
However, the petitioner shall abide by the conditions stipulated under Section 438(2) Cr.P.C. He shall also join investigation as and when called upon to do so.

The petition stands allowed.
