G.S.SANDHAWALIA, J. (Oral) On 16.03.2017, the following order was passed:- "After arguing for some time, it transpires that on account of bona fide requirement of the landlady, eviction has been ordered. The Appellate Authority had noticed that other tenants were evicted from the shops which were shown in the site-plan. In CR-905-2017, Ajay Kumar was the tenant, who was running a hair saloon and in his case, an undertaking was given that he would vacate the premises by 31.12.2017. The said revision petition was, accordingly, disposed of on 17.02.2017 by recording the said undertaking. Thus, faced with this situation, counsel prays for time to file necessary affidavit in the same terms, for the purpose of re-location, since he is running a departmental store and seeks some time.
List on 24.03.2017, for the above-said purpose." In compliance of the above said order, counsel for the petitioner has filed affidavit of the petitioner that possession of the premises in question shall be handed over by 24.03.2018. C.R. No. 1855 of 2017 that the possession of the demised premises will be handed over to the landlady only and not to anyone else and the rent will be paid by the 7th of every month.
Resultantly, keeping in view the above undertaking, the present revision petition is disposed of by binding the tenant to the above said undertaking. It is, however, made clear that the petitioner will not hand over the possession to anyone else except the landlady, as undertaken. He will also deposit all the arrears of rent and continue paying the rent by the 7th of each month. In case of violation of any of the above said conditions, the landlady will be entitled to take possession before the stipulated date. In case the vacation is not done by the stipulated date, the Rent Controller will get the possession handed over to the landlady with the help of police, if required.
