There is no scope for intervention in a direction for payment of interim maintenance for a wife in the matrimonial proceedings initiated by the husband. The husband's contention is that the wife is running tuition classes and she has enough money to support herself. His contention again is that he is having treatment for repeated episodes of Seizures. I have looked the medical certificate and find that the husband has history of drug abuse and he is in a process of rehabilitation. The certificate issued by the doctor only showed that he requires medical attention but does not bring out any instance of disability of person to be not earning at all. I find again no instance of non-functioning of brain as the counsel make it appear, an induced disfunction of brain by drug cannot be a justification at all for a person to deny liability.

There no reason for intervention in the revision petition. The revision petition is dismissed.
