There is no scope for intervention to an order passed on application under Section 24 of the Hindu Marriage Act where the trial Court has awarded ` 4,000/- to be paid by the husband to the wife as maintenance. The petitioner's grievance is that he has old parents to take care apart from his brother who is 90% disabled. He does not have enough money to pay. He has also a grievance that the wife is not leading a proper life and she cannot be empowered by payment of maintenance during the pendency of the proceedings. 2.
I will not find any reason to go into the merits of the case to decide on the issue of maintenance. ` 4,000/- as maintenance for a woman to keep her body and soul together cannot be taken as high even for an agricultural labour to pay to his wife. If he has old parents and brother to take care, he will just as well take care of wife also. I decline to make any intervention. The civil revision is dismissed. If the petitioner is prepared to tender all evidence and seek for a day to day disposal, the trial Court will consider the same and will not adjourn the case unnecessarily and endeavour to dispose of the case as expeditiously as possible.
