Learned State counsel on receipt of instructions from SI Kuldeep Singh present in Court submits that the petitioner has joined the investigation on the previous night in pursuance of notice issued under Section 41-A of Cr.P.C and neither his custodial interrogation is required by Investigating Agency nor any recovery is to be effected and therefore, at this stage, he is not required to be arrested in this case.

In view of above submissions made by learned State Counsel, learned counsel for the petitioner submits that the petition may be dismissed as withdrawn, at this stage.
