Mr.Arun Yadav, Advocate, for the petitioner. Rajan Gupta, J (Oral) Present revision is directed against the order passed by Civil Judge (Sr.Div), Rewari whereby evidence of the plaintiff has been closed by order.
Trial court has observed that eight effective opportunities have been availed by the plaintiff for concluding the evidence, but he failed to do so. Learned counsel for the petitioner submits that in case one opportunity is granted, he would conclude his evidence. This court feels that plea of the petitioner deserves to be accepted. Impugned order is setaside. Trial court would grant one opportunity to the plaintiff to conclude his evidence at his own risk and costs. This court is conscious of the fact that order is being passed without notice to the respondent. Plaintiff will thus be liable to pay Rs.6,000/- as costs to be remitted to the respondent. Revision petition is allowed in these terms.
