The defendant is the revision petitioner before this Court against the order passed by the trial Court dismissing his application for granting an opportunity to bring evidence of a thumb impression expert who will make a comparison of the thumb impression found in the Will produced before the Court already and thumb impression in an admitted document where the witness has affixed his thumb impression. The counsel says that he will produce his witnesses at his own risk and will not ask for any further time.

The order passed already is set aside dispensing with notice to the respondents with condition that the petitioner pays ` 10,000/- as costs to the plaintiff within a week after receipt of copy of this order. The Court will grant one more opportunity and give period not more than 10 days from the date when copy of the order is received by the Court.

The impugned order is set aside and the civil revision is allowed on the above terms. The respondents will be at liberty to approach this Court for modification or review of this order if the petitioner is guilty of suppression of material facts at the time when the order was passed.
