Petitioner has filed instant petition under Section 482 of 0$6/$7)+$7 0) 01"!"8 for grant of anticipatory bail in FIR No.8 dated 23.11.2024 under Sections 67, 67 (A), 67 (B) of Information Technology Act, 2000, Section 12 of the Protection of Children from Sexual Offences Act, 2012, Section 308 (2) of Bharatiya Nyaya Sanhita, 2023 and Section 61 (2) of Bharatiya Nyaya Sanhita, 2023 registered at Police Station Cyber Crime Police Station Fazilka, District Fazilka.  2.

Learned counsel representing petitioner states that as per the directions of this Court he has already joined the investigation and the mobile phone was also handed over to the police. He is still ready to abide by the terms of bail order.

In the case in hand, arrest of the present petitioner was stayed subject to the joining of investigation as per order dated 01.08.2025 which

" runs as under:- "Petitioner has filed the present petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in FIR No.8, dated 23.11.2024 (Annexure P-1), under Sections 67, 67(A), and 67-B of Information Technology Act, 2000, Section 12 of the Protection of Children from Sexual Offences Act, 2012 & Section 308(2) and 61(2) of BNS, 2023, registered at Police Station Cyber Crime Police Station Fazilka, District Fazilka. Status report has already been filed. It is pointed out by learned counsel representing State that during investigation conducted by the police, IP address of the mobile phone was procured and it was found that both mobiles phone numbers i.e. 87270-18217 and 96719-48270 were being used by the petitioner for uploading objectionable pictures. Learned counsel for petitioner states that petitioner is ready to cooperate with the Investigating Agency. He is ready to handover the mobile phone as well as the aforesaid sims.

Considering the aforesaid factual position, arrest of the present petitioner is stayed till next date of hearing with the direction to join the investigation and to cooperate with the Investigating Agency.

Today, learned counsel representing State of Punjab confirmed that petitioner has joined investigation. Mobile phone was recovered and it was sent to the Laboratory for the purpose of testing. On the instructions of SI Gurmail Kaur, it is submitted that petitioner is not required for further investigation.

Considering the aforesaid factual position, no purpose would be

8 served by sending him behind the bars. He has cooperated with the investigating agency. Therefore, anticipatory bail petition filed by the petitioner is allowed. He be not arrested. In case of his arrest, he be released on bail to the satisfaction of Arresting/Investigating Officer concerned, subject to condition that petitioner will join investigation as and when required. He will not tamper with or interfere with investigation and will not leave country without prior permission as provided under Section 482 (2) of BNSS, 2023.
