Present:

Rajan Gupta, J (Oral) Present revision is directed against the order passed by the court below whereby application moved by the plaintiff-petitioner to examine document expert in rebuttal evidence has been rejected. It appears that plaintiff filed a suit for recovery of Rs. 2,50,461/- against the defendant. At the stage of affirmative evidence plaintiff led his evidence in support of his claim. Thereafter, an application for amendment of plaint was moved. Same was allowed on 25.2.2016. Defendant also led his evidence thereafter and examined document expert who denied the signatures on the pronote and receipt. Thereafter, an application was moved by the plaintiff for leading additional evidence. Same was rejected by the court below. As the case reached the stage of rebuttal evidence, instant application has been moved to examine handwriting expert. Plea has been rejected by the court below. Admittedly, rebuttal evidence was closed on 12.2.2016. Earlier order

C.R. No. 1959 of 2017 2 could not have been reviewed by the court below. Under the circumstances, I find no ground to interfere in the revisional jurisdiction.

Dismissed.

Needless to observe that trial court shall appraise the entire evidence on record before arriving at final conclusion. Petitioner shall be at liberty to raise all his pleas before the trial court at that stage. (Rajan Gupta) Judge April 28, 2017.
