R.P. NAGRATH, J. (ORAL) CM-1547-CII-2015 Prayer in the instant application filed under Order IX Rule 9 read with Section 151 of the Code of Civil Procedure (CPC) is for recalling the order dated 13.1.2015 and for restoration of the main revision at its original number.
Learned counsel for the respondents does not have any opposition to the prayer made in the instant application. In view of the above and for the reasons stated in the application, which is supported by an affidavit, the instant application is allowed and the instant revision is restored at its original number. CR-2281-2013 (O&M) -2prayer that the instant petition may be disposed of, with liberty to the petitioner to apply to the trial Court seeking permission to alienate the property in question, in case of any exigency. In view of the above, the instant petition is disposed of, with a direction to the trial Court to dispose of the said prayer whenever made during pendency of the suit without being influenced by the observations made in the impugned order and upon its own merits. The trial Court is also directed to dispose of the suit, expeditiously.
