(Oral) On 18.01.2023, the following order was passed :- "Delay condoned.

At the outset, learned counsel for the petitioner contends that the petitioner is ready and willing to settle all the issues with the respondentwife. Notice of motion for 25.05.2023 for the purpose of amicable settlement of issues between the parties."

Office note indicates that service has been effected upon the respondent. However, none had chosen to appear on behalf of such respondent on 07.05.2024. The same is the position even today. Notice of motion dated 18.01.2023 reflects that the same was issued for the limited purpose of amicable settlement of issues between the parties. Ergo, the right of the petitioner to contest on merits already stood foreclosed by the said order. Keeping in view the entirety of facts and circumstances of the case, especially that the respondent-wife is not appearing, the instant petition is dismissed.
