This is the second petition under Section 438 of the Cr.P.C., whereby, the petitioner has sought the relief of his being granted the concession of anticipatory bail in FIR No.83 dated 01.09.2023, under Sections 452, 323, 148, 149, 506 of the IPC (offences under Sections 458 and 325 of the IPC added subsequently), registered at P.S. Ghanaur, District Patiala.

The earlier petition, i.e. CRM-M-60859-2023, wherein, the petitioner had sought an alike relief, as claimed herein, was dismissed as withdrawn by this Court, vide order dated 04.12.2023. However, the petitioner was granted liberty to surrender before the learned trial Court and to make an application for bail before the latter. 3.
Since there is no change of circumstances, nor any concrete supervening events have been brought before this Court, wherethrough, the instant second petition, on the same cause of action, can be permitted to be maintained, therefore, the instant petition is dismissed being non maintainable.
