The written statement was not filed within the time granted by the Court and the Court has, therefore, struck off the defence. Order 8 Rule 1 provides for outer limit of 90 days for filing the written statement failing which the defence can be ordered to be struck off. If the written statement has not been received, the petitioner may file an application for receiving the written statement and set out the reasons why he could not file the written statement. The Court is bound to receive the written statement if adequate reasons are shown. 2.
