******* SURINDER GUPTA, J.(Oral) Learned counsel for the petitioner seeks permission to withdraw the petition with submission that as per his instructions, Elizabeth is either no more or a non-existing lady as such, her power of attorney in favour of Mr. Kundan Lal Gill is a result of fraud. The appellant will move application to this effect before the first Appellate Court.

Dismissed as withdrawn with liberty as prayed for. On filing of such application by the petitioner, the first Appellate Court will pass the order in accordance with law.
