The prayer in the present petition under Article 226/227 of the Constitution of India is for issuance of a direction to respondent Nos.2 and 3 to protect the life and liberty of the petitioners and their family members at the hands of respondent Nos.4 to 11.
Learned counsel for the petitioners would contend that respondent Nos.4 to 7 are preventing the petitioners from carrying out the construction of their house of which they are the legal owner. The learned counsel would further contend that in this regard the petitioner No.1 has already made an application dated 24.12.2021 (Annexure P-3) to the Commissioner of Police, Jalandhar - respondent No.2. However, till date no action has been taken.
Learned counsel for the petitioners states that at this stage he limits his prayer and would be satisfied if a direction is issued to the PARKASH CHAND 2022.01.20 21:20 I attest to the accuracy of this order
CRWP No.504 of 2022 -2Commissioner of Police, Jalandhar - respondent No.2 - to take appropriate action on the said application dated 24.12.2021 (Annexure P-3) in a timebound manner. Notice of motion.
On the asking of the Court, Mr. H.S. Multani, AAG Punjab has joined the session through video conferencing and accepts notice on behalf of respondent Nos.1 to 3. Learned counsel for the State submits that he has no objection if the present petition is disposed off with a direction to respondent No.2 to take appropriate action on the aforesaid application dated 24.12.2021 (Annexure P-3) as per law.
In view of the limited prayer made by learned counsel for the petitioners, service of notice upon the other respondents is dispensed with and without expressing any opinion with regard to the veracity of the contents of the petition, the present petition is disposed off with a direction to the Commissioner of Police, Jalandhar - respondent No.2 - to take appropriate action on the application dated 24.12.2021 (Annexure P-3) expeditiously and in accordance with law.
Disposed off accordingly.
