CORAM:HON'BLE MR. JUSTICE AMIT RAWAL -.- AMIT RAWAL J. (ORAL) The present revision petition is against the order declining the amendment to incorporate relief of declaration. Mr. Deepender Singh, learned counsel appearing for the respondents submits that the suit has been decreed and the appeal against the same has been filed by the defendants. In view of the aforementioned, the petitioner-plaintiff shall be able to take remedy as per the provisions of Order 41 Rule 22 CPC and as well as the provisions of Order 43 Rule 1A CPC viz-a-viz the impugned order i.e. declining the application for amendment of the plaint, if need arises.
With the aforementioned observations, the revision petition stands disposed of.
