The petitioner's grievance is that his evidence by way of rebuttal was denied although the rebuttal was sought only with reference to issues, the burden of which was on the respondents. I dispense with notice to the respondents and allow the benefit of such evidence to be given by the petitioner and the Court will also consider if there are any issues which are cast on the petitioner in the consolidated suits and the respondents have to rebut any evidence which is given by the petitioner.

The impugned order is set aside and the revision petition is allowed on the above terms.
