The petitioner before this Court is a defendant in the suit for the grant of decree of permanent and mandatory injunction. An application filed by the plaintiff for permission to lead additional evidence has been allowed subject to the payment of cost of ₹ 10,000/- by the trial Court. Challenging its correctness, the present revision petition has been filed. 2.
The learned counsel representing the petitioner has chosen not to enter appearance, through the case has been called twice. The trial Court, in exercise of its discretion and for the cogent reasons recorded, has permitted the plaintiff/respondent No.1 to lead additional evidence. The trial Court has noticed all the facts before passing the order. 3.
