The order of rejection of application under Order 9 Rule 9 CPC is appealable under Order 43 Rule 1 CPC. The revision petition is not maintainable.

The revision petition is dismissed but the petitioner will have a liberty to prefer an appeal. If there is delay in preferring the appeal, the petitioner may explain the cause for such delay by means of application under Section 14 of the Limitation Act. If such application is accompanied with the grounds of appeal, the Appellate Court will consider the same and pass appropriate orders. (K.
