The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents No. 2 and 3 to re-issue him passport.

The petitioner, on 26.10.2012, was issued passport which was valid for ten years. The petitioner left India and started living in Milan (Italy). While the petitioner was in Italy, he applied for re-issuance of passport which was re-issued for a period of one year from 20.12.2021 to 19.12.2022. The petitioner again applied for issuance of passport which was re-issued for a period of five years from 27.01.2023 to 26.01.2028. The petitioner on 14.02.2023 came to India and unfortunately lost his passport alongwith his driving licence. CWP No.1130 of 2024 -2- 2024:PHHC:007003 police and further applied for re-issuance of passport. The application of the petitioner is still pending and he has to leave for Italy. 3.

Notice of motion.

Mr. Yash Pal Sharma, Central Government Counsel for Union of India, who on advance notice is present in Court, accepts notice and waives service. He submits that application of the petitioner is under consideration and could not be processed because of some information from authorities at Italy is still pending. He assures the Court that as soon as information is received from authorities at Italy, the application of the petitioner would be processed and appropriate order shall be passed. 5.

The passport authority cannot keep application of an applicant pending for an indefinite period on the ground of non-receipt of information from any quarter. It is responsibility of the passport authority to collect information. The passport authority is directed to process application of the petitioner within three months from today.
