(Oral) By way of filing the present application, applicant Sunita Rani, who is respondent in a petition under Section 9 of the Hindu Marriage Act filed by her husband Sukhdev Singh titled as 'Sukhdev Singh Vs. Sunita Rani' pending before Addl. Principal Judge, Family Court, Ludhiana, seeks transfer of that petition to the Court of Principal Judge, Family Court, Anandpur Sahib, District Rupnagar. 2.
According to the applicant, she is unemployed and is totally dependent upon her parents; she has no source of income; she is not keeping good health; the distance between Ludhiana and Anandpur Sahib is about 114 kms and it is difficult for the applicant to travel such distance alone when her parents are old, not keeping good health. A petition U/s 125 Cr.P.C. filed by her had been pending in the Court at Anandpur Sahib which has since been decided ex parte. Notice of the petition was given to the respondent who was duly served but failed to put in appearance to offer a contest. 4.
I have heard learned counsel for the applicant besides going through the record.

Keeping in view the contentions in the application and submissions made by learned counsel for the applicant, in which I find merit, in absence of any strong circumstance to the contrary, it would be proper and appropriate, if the application is accepted. The same is accordingly allowed. The petition in question is ordered to be withdrawn from the Court of Addl. Principal Judge, Family Court, Ludhiana and transferred to Family Court at Anandpur Sahib for disposal in accordance with law.

The parties are directed to appear in the transferee Court on 22.08.2023. Copies of order be sent to both the Courts through their respective District & Sessions Judge, for information and necessary compliance.
