Vide impugned order dated 26.2.2015, application under order VI Rule 17 CPC for amendment of the written statement to incorporate the plea of counter claim has been declined. Counsel for the petitioner submits that the suit is at final stage of arguments and the arguments have already been heard on 11.5.2015.

Counsel for the petitioner seeks permission to withdraw this petition in view of the stage of the suit but submits that his legal rights to enforce his claim independently be not prejudiced. This petition is disposed of as withdrawn without prejudice to the rights of the petitioner under Order XLIII Rule 1 (a) CPC in case the suit of the plaintiffs-respondent is decreed and in case the suit is dismissed to enforce the legal rights in accordance with law.
