There is no merit in plea for staying suit which is subsequently instituted at the instance of respondent No.5. It appears that an assignee of agreement from respondent No.5 one Atul Kumar has himself filed the suit in the year 2009. It will be appropriate if both the cases are tried together to secure an adjudication without in any way to stall one proceedings for the pendency of the other. 2.
The civil revision is dismissed but it will be open to the petitioner to apply to the Court where the case is pending for consolidation of both the suits and if such a request is made, the Court shall consider the same and dispose of the application.
