AMIT RAWAL J. (Oral) The present revision petition is directed against the impugned order dated 02.12.2017 (Annexure P-5), whereby, the application filed by the respondent-defendant under Order 7 Rule 11 (d) CPC, was allowed. The impugned order is a decree as per the provisions of Section 2(2) CPC which is appealable. It is also made clear that any appeal filed against such orders would not miscellaneous appeal but under Section 96 CPC.

In view of the aforementioned fact, learned counsel for the petitioners seeks liberty of this Court for withdrawal of the present revision petition with liberty to the petitioners to avail the remedy of appeal, in accordance with law.

Ordered accordingly.
