AMIT RAWAL J. (Oral) The present revision petition is directed against the impugned order dated 23.02.2018 (Annexure P-3), whereby, the application for summoning clerk/accounts officer alongwith record for the year 2008-09 and 2009-10, was dismissed by the Arbitrator on the ground that claim of the respondents was for the crop year 2010-11. Mr. Vinod Khunger, learned counsel for the petitioners submitted that the petitioners have no other remedy against the interim order of the Arbitrator, therefore, the jurisdiction under Article 226 of the Constitution of India having all the superintendent powers, has been invoked.
I am afraid that the aforementioned order is not revisable and remedy for the petitioners is to assail the award by taking one of the grounds Savita 2018.04.03 10:32 I attest to the accuracy and integrity of this document High Court Chandigarh
CR No.2136 of 2018 {2} by raising the objection under Section 34 of the Arbitration and Conciliation Act, 1996 and also plea of adverse inference. Faced with this situation, learned counsel for the petitioners seeks liberty of this Court for withdrawal of the present revision petition. Ordered accordingly.
