The revision petition is against the order dismissing an application for restoration of the suit which was dismissed for not taking steps to serve all the respondents in the application but ultimately the Court decided to dismiss the application on an assumption that the plaintiff had not taken steps earlier and therefore, it cannot be restored.

The order is patently wrong and it is set aside. I dispense with notice to the respondents having regard to the fact that the suit has not come to the stage of contest yet and no prejudice can be caused. The impugned order is set aside. The suit is restored to file and the counsel who had been appearing for the respondents shall be directed to take notice in suit as well. The Court shall call upon the defendants to file the written statement and proceed to dispose of the case in accordance with law.
