It is a case of version and cross-version. Petitioners in CRM-M2929-2025 are seeking quashing of FIR No.75 dated 21.06.2022, under Sections 379, 324, 323, 148, 149 IPC (Section 326 IPC added later on) registered at Police Station Zira District Ferozepur and all subsequent proceedings arising therefrom, whereas petitioners in CRM-M-3032- 2025 are seeking quashing of G.D.R. No.37 dated 21.06.2022 under Sections 323, 324,

-2148, 149 IPC and SC/ST Act added later on, registered at P.S. Zira District Ferozepur, as a cross-version case in FIR No.75, dated 21.06.2022, under Sections 379, 324, 323, 148, 149 of IPC (Section 326 of IPC added later on), and all subsequent proceedings arising therefrom, on the basis of compromise/affidavits dated 22.01.2024 and 07.12.2024 (Annexures P-2 and P-3 respectively), arrived at between the parties. 2.

Vide order dated 22.01.2025, the affected parties were directed to appear before the learned Trial Court/Illaqa Magistrate, for getting their respective statements recorded with regard to the compromise. 3.

Report has since been received from learned Judicial Magistrate Ist Class, Zira, in pursuance to the directions of this Court wherein, the factum of the compromise arrived at between the parties stands verified and confirmed. As per the report(s) compromise has indeed been effected between the parties and the same is without any pressure or coercion and out of their free will and the private respondents have also made statement to the effect that they would have no objection if the GDR and FIR qua the accusedpetitioners are quashed. 4.

The trial Court has annexed the photocopies of the statements of the parties along with its report. The relevant part of the said report is reproduced here-below:

Learned State counsel too submits that there are no other accused other than the petitioners and the private respondents No.2 and 3 are the only aggrieved person in the FIR and the GDR in question. 6.

In view of the report of the learned Judicial Magistrate Ist Class, Zira, and the principles laid down by Hon'ble the Apex Court in Gian Singh Vs. State of Punjab and others (2012) 10 SCC 303, and also by the Full Bench of this Court in Kulwinder Singh and others Vs. State of Punjab and another, 2007(3) RCR (Criminal) 1052, the instant petitions are allowed. The aforesaid FIR, GDR and all consequential proceedings arising out of them, are quashed.

Needless to say that the parties shall remain bound by the terms of compromise and their statements recorded before the Court below.
