******* SURINDER GUPTA, J.(Oral) Learned counsel for the petitioner submits that he will file appeal against impugned order as per provisions of Order 43 Rule 1(w). Earlier also he filed appeal, which was withdrawn under the impression that the same was not maintainable. He seeks permission to withdraw the instant petition with liberty to file appeal.
Dismissed as withdrawn with liberty, as aforesaid. As the instant petition has not been decided on merit, the earlier order of withdrawal of appeal and filing of this revision petition will not come in the way in disposal of the appeal, if preferred, by the revision petitioner.
