There is no justification for the petitioner to arrive to this Court to complain that the defence has been struck off for not filing the written statement within the time prescribed. Time prescribed under Order 8 Rule 1 CPC is directory and it is open to the petitioner to apply to the Court to seek for permission to file the written statement and explain the circumstances for not filing the written statement within time. If such application is filed along with the written statement, the Court will consider the same and pass appropriate orders. 2.
Notice to the respondents is dispensed with and the revision petition is disposed of on the above terms.
