The petitioner has grievance that his side was closed when the witness did not come. The grievance is that on three earlier occasions when the witnesses had come, there was no cross-examination by the defendant and on one occasion when he did not come, the Court has closed the evidence. The order passed by the Court below is set aside on payment of costs of `5000/- within a period of one week from the date of receipt of copy of this order, failing which the order passed already will stand.

The revision petition is disposed of dispensing with notice to the respondents.
