(Oral) The present revision petition is directed against the impugned order dated 06.03.2018 (Annexure P-9), whereby, the application filed by the defendants for framing of preliminary issues, was dismissed. On instructions from his clients, Mr. Jaideep Verma, learned counsel for the petitioners submitted that suit is listed for filing the replication.

I am afraid that the said application was not maintainable being premature. As and when the Court would have applied the mind for framing of preliminary issues, the party is at liberty to apprise the Court by pointing out the objections taken in the written statement for framing the issues as preliminary issues but not in the manner and mode as indicated above.
