There is no justification for the petitioner to arrive before this Court to complain that the side was closed on account of his absence. If there is a valid justification for the petitioner, he will have right to apply to the same Court to have the case which was closed to be reopened and seek for permission for examination of further evidence. This point was laid down by this Court after considering the judgments of the Supreme Court in Santosh Kumar Berry Vs. Nirmala Devi and others 2013(1) PLR 404. The petitioner will resort to such remedy. 2.
