**** RITU BAHRI , J. (Oral) Petitioner is seeking quashing of impugned order dated 09.01.2019 (P-10) vide which the order transferring the petitioner from Yamuna Nagar to Karnal was cancelled.

Mr. Deepak Sonak, Advocate appears on behalf of respondent No. 5 and has referred to order dated 25.10.2018wherein petitioner was held not to be entitled for any TA/DA. The order dated 25.10.2018 is taken on record as Annexure A-1. Learned counsel appearing for respondent No. 5 further states that petitioner had requested to transfer him from Yamuna Nagar to Karnal Reference at this stage can be made to policy dated 06.10.2005 (P11) wherein it has been observed that an employee can be transferred on his requested on mutual basis or against the vacant post. The case of the petitioner was not covered under the above policy and thus requires to be dismissed,as private respondent No. 5 could not be transferred just to accommodate the petitioner. Dismissed. However, the petitioner is at liberty to make representation for release of his salary.
