The defendant is aggrieved that the plaintiff's witnesses PW1 to PW3 and the persons examined even before written statement being filed, have not been allowed to cross-examine by recalling them. The order already passed is set aside dispensing with notice to the respondents on condition that the defendant pays `10,000/- to the plaintiff as costs for the inconvenience casued and for delaying the proceedings for filing the written statement beyond the time of what was statutorily granted. The costs shall be paid within a period of one week from the date of receipt of copy of this order failing which the order already passed shall stand confirmed.

The impugned order is set aside and the civil revision is allowed on the above terms.
