CR-2205-2018 -1-

IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH.

Civil Revision No.2205 of 2018 (O&M) Date of Decision:April 04, 2018.

Prem Sagar Dogra and another ......PETITIONER(s).

VERSUS

Ajit Singh ....RESPONDENT(s).

CORAM:- HON'BLE MR. JUSTICE SURINDER GUPTA

Present:

Mr. Sharan Sethi, Advocate for the petitioner (s).

******* SURINDER GUPTA, J.

Heard.

Learned counsel for the revision-petitioner argues that as per the case of the plaintiff, he has purchased share of K.P. Razdan and Gitanjali Sharma, sisters of Prem Sagar, revision-petitioner No.1 in the suit property. Revision petitioners are challenging the sale made by their sisters and moved application to implead them as party which was declined by the lower Court.

Plaintiff-respondent on the strength of purchase of share of K.P. Razdan and Gitanjali Sharma has filed suit for partition of his share in the suit property. On perusal of plaint, copy of which has been placed on the paper book, I find that when no relief has been claimed against K.P. Razdan and Gitanjali Sharma, who after sale of their share in suit property cease to have any interest in it.

CR-2205-2018 -2In view of these circumstances, no reason is made out to implead them as party in this case. Consequently, I finds no merits in this revision-petition and the same is dismissed.
