This is a petition under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to count the service rendered by the petitioners in the Government Private Aided School for the purpose of qualifying service towards pensionary benefits.

Learned counsel for the petitioners contends that a Legal Notice dated 26.10.2020 (Annexure P-6) in this regard has been sent to the respondents. However, no action has been taken on the same. The learned counsel would further contend that at this stage he limits his prayer and would be satisfied if a direction is issued to the respondents to take action/decide the Legal Notice dated 26.10.2020 (Annexure P-6) in accordance with law in a time-bound manner.

In view of the limited prayer made by the learned counsel for the petitioners, the present petition is disposed off with a direction to respondent No.1 to take a decision on the Legal Notice dated 26.10.2020 (Annexure P-6) by passing a speaking order in accordance with law expeditiously and, in any case, within a period of three months from the date of receipt of a certified copy of this order and, in case the petitioners are found entitled to the benefits, as claimed, the same may be released to them within a period of two months thereafter.

Disposed off.
