This second petition for regular bail has been filed by petitioner Baljeet Kaur, aged about 30 years, daughter of Singara Singh, resident of Papara, District Bharatpur, Rajasthan, an accused in F.I.R No. 8 dated 8.1.2020 under Section 15 of the NDPS Act (later on Section 61/85 of NDPS Act added in the challan) registered with Police Station City Fatehabad. The first petition filed by the present petitioner and his coaccused bearing CRM-M-13215 of 2020 had been dismissed vide consolidated order dated 21.8.2020 by a coordinate Bench of this Court (Hon'ble Mr.

Justice Sanjay Kumar) for the reason that since recovery effected was amounted to commercial quantity, bar of Section 37 of the NDPS Act was there, as such regular bail could not be granted to the petitioner. The petitioner has approached this Court again seeking similar relief, which request is being opposed by the State counsel. On being asked, PARVINDER SINGH 2021.04.

CRM-M-2913 of 2021 learned State counsel has informed that challan has since been filed in the Court, charge has been framed and the next date of hearing fixed in the trial Court is 28.5.2021. He has further contended that the prosecution has cited 12 PWs.

I do not see any reason to grant regular bail to the petitioner. Therefore, the petition stands dismissed, however, the trial Court is directed to make earnest efforts to conclude the prosecution evidence within six months from today by giving short adjournments. Of course, the accused shall not ask for any adjournment for cross-examination of the PWs except for some compelling reason which be recorded in the interim order. (H.S.
