The revision petition is a challenge to the recounting ordered by the Election Tribunal. The contention was rested on a plea that without finding electoral lapses in the manner alleged by the defeated candidate in the election petition before the Tribunal, the Tribunal could not have passed the order of recount. The counsel appearing on behalf of the respondents points out that the order which is impugned was passed on a concession made by the respondent before the Tribunal (now petitioner) in the written statement that she will have no objection to the recount. If the respondent had allowed for such concession in the written statement, a mere objection at the time when the Election Tribunal was passing an order that no recount can be done was not justified at all. The Tribunal was justified in passing the order for recount on the basis of concession given by the elected candidate in the PANKAJ KUMAR 2015.11.03 12:05 I attest to the accuracy and integrity of this document
