SUVIR SEHGAL, J. (Oral) The Court has been convened through video conferencing due to Covid-19 pandemic.
Through the instant petition, the petitioner seeks anticipatory bail in case FIR No.155 dated 13.10.2019 registered under Sections 323, 324, 506, 148, 149 of Indian Penal Code, 1860 (Section 326 IPC was added later on), at Police Station Bullowal, District Hoshiarpur. On 24.03.2021, this Court passed the following order:- "The matter has been taken up through video conferencing. On request of learned State counsel, adjourned to 14.07.2021. Seeking ad interim anticipatory bail, learned counsel for the petitioner inter alia contends that the petitioner has been
{2} falsely implicated in the case; it is a case of version and crossversion; the complainant side was the aggressor; the petitioner received four injuries at the hands of the complainant party; the injury which is attributed to the petitioner was initially declared as simple in nature and after a period of one year the same has wrongly been classified as grievous injury only for the purpose for putting the petitioner behind the bars; there is no other criminal case against the petitioner and that the petitioner is ready and willing to join the investigation as and when called by the investigating agency.
After considering the above submissions, it is directed that till the next date of hearing, subject to the petitioner's joining investigation as and when called by the investigating agency as also abiding by the other conditions provided under Section 438(2) Cr.P.C, in the event of his arrest in FIR No. 155 dated 13.10.2019 under Sections 323, 324, 506, 148, 149 IPC (Section 326 IPC added later on) registered at Police Station Bullowal, district Hoshiarpur, he shall be released on ad interim anticipatory bail to the satisfaction of the Arresting Officer."
Learned State counsel, on instructions from ASI Kashmiri Lal submits that the petitioner has joined investigation and is no longer required for custodial interrogation. He has further instructions to submit that no
{3} other case is pending against the petitioner. In view of the above facts, but without commenting on the merits of the case, the present petition is allowed and the order dated 24.03.2021 granting interim bail to the petitioner is made absolute, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure.
