(Oral) On 17.01.2019, this Court passed the following order:- "Learned counsel for the petitioners contends that as per final result (Annexure P-1), petitioners have qualified the lower school course in Batch No.52. Persons junior to them had qualified this result in Batch No.53 as per communication dated 24.12.2018 (Annexure P2). Notice of motion for 25.04.2019.

To be heard along with CWP-40651-2018.

Meanwhile, petitioners, who are in Batch No.52 i.e. Serial No.1 to 17, shall be deputed to the intermediate school course, subject to the final decision of this petition. Petitioners at serial Nos.18 to 30, who are in Batch No.54 shall not be sent to the said course." Learned State counsel has filed a short reply on behalf of respondent No. 3 and the same is taken on record. As per reply, the seniority in the rank of Head Constables is maintained at Range Levels, as per order of merit in the Lower School Course in list C-1. The petitioners in the present case belongs to Karnal range whereas they are compromising themselves with officials/Head Gaurav Arora 2019.02.28 17:17 I attest to the accuracy and integrity of this document Chandigarh

CWP No. 1293-2019 Constables of Commissionerate, Gurugram. No junior Head Constable to the petitioners have been sent for intermediate school course 2019 from Karnal Range, Karnal. The petitioners have passed Lower School Court in batch No.52/ 53/54 whereas the last deputed Head Constable for intermediate school course 2019 is HC Parveen Kumar and he is from Batch No. 52 and he is senior in Karnal Range as per order of merit in lower school Course Batch No. 52 to each of the petitioner from general category, backward category and SC category. The details of petitioners as well as HC Parveen Kumar is given in para no. 5 and 6 of the reply. The petitioners i.e at Sr.No. 1,2,4,5,8,9,12 to 22 and 27 to 29 belongs to General category, petitioners at Sr. No. 3,6,7,10,11,25,30 are from Backward category and petitioner Nos. 23, 24 and 26 belongs to SC category. In view of the reply filed by the State, no ground is made out for issuance of direction to the respondents to consider the name of the petitioners for Intermediate School Course 2019.

Dismissed.
