The petitioner seeks grant of regular bail in respect of aforementioned FIR.

The allegations in nutshell are that three persons with muffled faces had snatched a bag containing currency notes worth Rs.21,000/- from the complainant and also his wallet containing currency notes worth Rs.2200/- on 10.10.2023.

Learned counsel for the petitioner submitted that he is nowhere named in the FIR and has been nominated as an accused on the basis of his alleged VIMAL KUMAR 2024.03.13 11:04 I attest to the accuracy and integrity of this document

CRM-M-2578-2024 (O&M) -2admission, when he was apprehended in connection with another case and which would hardly be termed as a 'credible evidence'. 4.

Opposing the petition, learned State counsel submitted that having regard to the fact that the petitioner, who came to be arrested in some other case, himself disclosed regarding his involvement in the present case, his complicity is clearly evident. It has been informed that apart from said other case i.e. FIR No.372 dated 27.10.2023 registered at P.S.City Faridkot, under Sections 379-B, 323, 324, 411 IPC, there is no other case against the petitioner. Learned State counsel has informed that although charges have been framed, but none out of cited 10 PWs has been examined. It has also been informed that the petitioner as on date has been behind bars since the last about 4 months & 5 days. 5.

This Court has considered rival submissions.

Without commenting anything as regards the merits of the case, but while noticing that the petitioner has been behind bars for the last more than 4 months, further detention of the petitioner will not serve any useful purpose as the conclusion of trial will take some time inasmuch as none out of cited 10 PWs has been examined till date.
