The civil revision is untenable and cannot stand a minute's scrutiny. An objection was taken by the defendant by moving an application under Order 7 Rule 11 CPC seeking for rejection of the plaint on the ground that the court fee was not paid. The Court while allowing the application ordered the plaintiff to pay the ad valorem court fee. If the Court has passed an order that the court fee is required to be paid ad valorem, there can be no exception to such order.
