There is no scope for interfering with the order passed by the Court below that found that there was no justification for moving an application for amendment after the commencement of the trial. Amendment under Order 6 Rule 17 CPC is permissible only to points which in spite of due diligence could not have been stated at the time when the original pleading was filed.

There is no illegality in the order passed by the Court below for intervention in the revision petition. The revision petition is dismissed.
