There is no justification for interference in an order that is passed by the Court below allowing for interim maintenance of ` 5,000/- per month against the husband. The Court has observed that he is NRI settled in England and though no specific documentary evidence was placed, an amount of ` 5,000/- per month would be appropriate and just for payment to the wife.

The counsel for the petitioner-husband states that he has come back to India and he is not having any means to support her. It is also his contention that the wife is employed in Court and she has not disclosed her means. There is no such statement brought before the Court below for consideration that the wife had sufficient means to support herself. The Court was justified in awarding the modest sum as maintenance considering the status of the party, particularly in view of the fact that he had been living away in England for long number of PANKAJ KUMAR 2015.05.21 16:54 I attest to the accuracy and integrity of this document
